1. Who we are

Max Pierce Consulting provides permanent and fixed-term recruitment, Professional Search and related appointment assessment services across Sales Leadership, Legal, HR and Procurement & Supply Chain.

Max Pierce Consulting Limited is the data controller responsible for the personal information covered by this statement. We are registered in England and Wales under company number 15996499, with our registered office at 25 Rednal Road, Birmingham, B38 8DT. In this statement, “Max Pierce”, “we”, “us” and “our” mean Max Pierce Consulting Limited.

This statement explains how we use personal information about candidates, prospective candidates, client contacts, referees and visitors to maxpierceconsulting.co.uk.

2. Information we collect

We collect information relevant to providing our services. Depending on your relationship with us, this may include:

We seek only information relevant to the purpose for which it is collected. Please do not include unnecessary sensitive information in your CV or enquiry. If a recruitment process requires sensitive information, we will explain the purpose and legal basis before collecting it.

3. Where information comes from

We obtain information directly from you through enquiries, applications, conversations, interviews and assessments. We may also obtain relevant professional information from LinkedIn, other public professional sources, recruitment platforms and job boards where their terms and your settings permit access, and from recommendations, clients and referees.

Where we obtain information indirectly, we will explain the source and provide this privacy information within the applicable legal timeframe—normally within one month, or at our first communication or disclosure if earlier—unless a lawful exception applies.

4. Why we use information and our lawful bases

PurposeLawful basis
Identify and contact potential candidates, understand career interests and assess suitability for appointments.Legitimate interests in providing effective recruitment and search services, balanced against your rights and reasonable expectations.
Conduct interviews, assessments and referencing; coordinate introductions and recruitment processes.Legitimate interests in evaluating relevant capability and supporting informed appointment decisions.
Respond to enquiries, develop client relationships and deliver agreed services.Legitimate interests. Contractual necessity applies where processing is needed for a contract with you personally or steps you request before entering one.
Keep required business records, meet applicable legal duties and respond to lawful requests.Compliance with legal obligations.
Maintain security and establish, exercise or defend legal claims.Legitimate interests and, where applicable, legal obligations.
Send relevant marketing communications or use cookies that require consent.Consent where required; otherwise legitimate interests where permitted by applicable marketing and cookie rules.

Where we rely on consent, you may withdraw it at any time. Withdrawal does not affect the lawfulness of earlier processing. Giving permission for a client introduction does not mean consent is the lawful basis for every use of your information.

Special category information, such as health information, requires both an ordinary lawful basis and a separate legal condition. Criminal-offence information is subject to additional legal restrictions. We will provide specific information about any such processing where applicable.

5. Sharing information and referencing

We share relevant candidate information with prospective employers to support an agreed recruitment process. We will obtain your permission before submitting an identifiable CV or disclosing your identity to a prospective employer. Removing your name does not necessarily make a profile anonymous; we will also consider whether other details identify you.

We agree the referencing approach with you before contacting referees. We will not contact your current employer for a reference without your permission. References and assessment information are used to examine relevant capability, achievements and suitability for the appointment.

We use Ezekia for our recruitment CRM, Microsoft for email and Searchstack for website hosting. These providers may process the information needed to deliver and support their respective services. We may also share necessary information with other providers supporting IT security, assessments and reference checks; with professional advisers; and with authorities where disclosure is legally required or justified. Providers acting on our behalf must process information under appropriate contractual instructions and safeguards.

Prospective employers generally act as separate data controllers and their own privacy statements apply to their use of information.

6. How long we keep information

Our retention policy is:

We do not keep complete candidate files indefinitely merely because a placement or business record must be retained. Consent does not automatically expire at the end of a retention period, and renewing consent does not justify keeping information that is no longer necessary.

7. Communications and marketing

We may contact you about relevant roles, an enquiry or an active recruitment process. Separately, we may send market insights and information about our services where permitted.

For marketing emails or texts to individuals, sole traders and certain partnerships, we obtain consent unless a lawful exception applies. Relevant marketing to corporate business contacts may rely on legitimate interests where permitted. You can unsubscribe or ask us to stop at any time.

You have an unconditional right to object to the use of your personal information for direct marketing, including related profiling. An objection to marketing does not prevent necessary communications about an ongoing service you have requested.

8. Website cookies and external links

Our website may use cookies and similar technologies. Our Cookie Policy provides further information. Our policy is to obtain consent before using technologies that require it and to enable withdrawal of that consent. Essential technologies and any technologies covered by a lawful exemption are subject to the applicable legal rules. Browser settings can also help you manage cookies.

Links to LinkedIn and other external websites lead to services with their own privacy and cookie policies.

9. International processing and transfers

Our service providers may process information in the UK, the European Economic Area (EEA), the United States and other locations where their authorised infrastructure, support teams or subprocessors operate. We do not promise that all information remains within the UK or EEA.

Ezekia, our recruitment CRM provider, publishes information describing UK/EU storage and international subprocessor arrangements, including certain US processing. Microsoft, our email provider, publishes data-location and international-transfer terms for its business services; the arrangements depend on the service and configuration. Searchstack provides our website hosting. Hosting, support and any underlying suppliers may also involve processing locations outside the UK.

Our policy requires any restricted international transfer to be covered by an applicable UK adequacy regulation or other lawful transfer mechanism. Where adequacy does not apply, this may include approved contractual safeguards, such as the UK International Data Transfer Agreement or the UK Addendum to the European Commission’s Standard Contractual Clauses, together with any required transfer assessment and supplementary measures. A provider’s US Data Privacy Framework certification is relevant only where the recipient and transfer fall within the applicable UK extension.

You can contact us for information about the arrangements relevant to your data and how to obtain a copy of applicable safeguards, subject to necessary redactions. Further provider information is available in Ezekia’s privacy policy and Microsoft’s business-service data protection guidance.

10. If you do not provide information

You can choose whether to provide personal information. If essential information is missing, we may be unable to assess your suitability, complete a required check, introduce you to a client or provide a requested service. We will explain which information is needed and why. Optional information is identified as such.

11. Recruitment decisions

Our assessment and recommendations involve human review, and prospective employers make their own appointment decisions. We do not make decisions producing legal or similarly significant effects on you solely through automated processing. If this changes, we will explain the processing and applicable safeguards before using it.

12. Your rights

Depending on the circumstances and the legal basis for processing, you may have the right to:

These rights are subject to legal conditions and exemptions. Contact us to exercise them. We may reasonably need to verify your identity. We normally respond within one month; where the law permits an extension or a pause to clarify a request, we will explain this. Requests are normally free of charge.

13. Contact us and complaints

For privacy enquiries or rights requests, contact Jason Culloo, Privacy Contact, Max Pierce Consulting Limited:

You may complain to the Information Commissioner’s Office (ICO) at any time. Visit ico.org.uk/make-a-complaint or call 0303 123 1113. We welcome the opportunity to address your concern, but you do not have to contact us before raising it with the ICO.
